Legal frame Pomorski zakonik (NN 181/04 as amended, last by NN 17/19) arts 5 and 126(2) [zakon.hr consolidation, secondary]; NN 17/19 arts 281 and 288; Pravilnik o brodicama, čamcima i jahtama NN 13/20 arts 3(3) and 4.
Three words that decide everything
Croatian law sorts sea-going craft by hull length and passengers, not by tonnage or use. Use comes in later, when manning and surveys are decided.
| Term | Hull length | Passengers (besides crew) | Notes |
|---|---|---|---|
| Brodica | over 2.5 m up to 15 m, or over 5 kW | up to 12 | boats, jet skis |
| Jahta | over 15 m | up to 12 | sport and leisure, private or commercial, "intended for longer stays at sea" |
| Velika putnička jahta | 24 m or more | 13 to 36 | added by NN 17/19 |
| Brod | over 15 m | or more than 12 | ships of every other kind |
NN 13/20 explains "longer stays at sea" in a footnote: a closed vessel with a superstructure, berths for everyone aboard, ventilation, lighting, drinking water, galley, toilets and escape routes. A 16 m open day boat is therefore an awkward fit, and surveyors will tell you so.
Commercial or personal
NN 13/20 art. 4 splits yachts by purpose:
- jahta za gospodarske namjene — a yacht "intended for hire with or without crew", which is the charter yacht;
- jahta za osobne potrebe — a yacht not used commercially.
The split matters later: annual surveys, AIS in area III, manning under art. 81 and the charter regulation NN 42/17 all key off commercial use.
The large passenger yacht gap
Before 2020 a yacht carrying 13 or more passengers was simply a ship. NN 17/19 created the velika putnička jahta and allowed owners of ships that fit the definition to re-register them as such (art. 281(4)). It also ordered the minister to adopt technical rules for large passenger yachts within one year (art. 288(2)).
No such rules were found in Narodne novine up to issue 111/2026. NN 13/20 expressly does not apply to these yachts (art. 3(3)). The result is a definition with no technical code behind it.
CAUTION — 13 guests is not a rounding error Selling a 30 m yacht for 16 day guests moves it out of the yacht regime you know. Ask the Ministry (MMPI) how it will be surveyed and manned before you take bookings.
The yacht "in international navigation"
PZ art. 126(2) adds a functional definition used for crew employment, tax and contribution rules (arts 127–129.a) and, through art. 429, for tonnage tax. It is a yacht of any flag with permanent crew that, over 365 consecutive days, makes at least 50 % of its voyages:
- from Croatia to a foreign port or back;
- between foreign ports; or
- on the high seas or in foreign territorial waters.
Worked example: a yacht logs 40 voyages in the year, 22 of them to or from Italy and Montenegro. 22 / 40 = 55 %, so it qualifies. With 18 such voyages the share is 45 %, and it does not.
TIP — Keep the voyage list The test counts voyages, so the deck log and port clearances are your evidence. Reconstructing a year of voyages from marina invoices is miserable work.
Where this course sits
This course covers the Croatian-flag commercial yacht and the people who crew it. For foreign-flag yachts operating in Croatia, see Foreign-Flag Superyachts in Croatia. For the titles themselves, see Zapovjednik Jahte A & B prep and Voditelj Brodice C prep.
