Legal frame
Governing: D.Lgs. 171/2005 (Codice della nautica da diporto) arts 2, 3 and 36, as amended to L. 70/2026. Builds on: Working on Yachts in Italy.
Why the words matter
Italian yacht law sorts every unit by hull length (measured to UNI EN ISO 8666) and, above 24 m, by gross tonnage. The label then decides the navigation documents, the survey regime, who may command, and who may crew. Get the label wrong and every later answer is wrong.
The size ladder (Codice art. 3)
| Term | Definition | What usually follows |
|---|---|---|
| Natante da diporto (small craft) | Up to 10 m, or any rowing boat; jet skis are a separate category | Not registered; commercial use annotated differently (art. 2(2-bis)) |
| Imbarcazione da diporto (pleasure boat) | Over 10 m and up to 24 m | Registered in the ATCN; licence and safety certificate |
| Nave da diporto minore (small pleasure ship) | Over 24 m, 500 GT or less (600 TSL) | Licence and safety certificate; enrolled crew |
| Nave da diporto maggiore (large pleasure ship) | Over 24 m and over 500 GT (600 TSL) | As above, with the heavier tonnage-based rules |
There is also a nave da diporto minore storica (over 24 m, up to 120 GT, built before 1967), which you will rarely meet in charter work.
Note that "nave" is a legal term, not a size impression. A slim 26 m sailing yacht of 90 GT is a nave; a beamy 23.9 m motor yacht is an imbarcazione.
When a yacht becomes a "commercial yacht"
Art. 3(1)(b) gives the English term its legal meaning: a commercial yacht is any unit used commercially under art. 2, plus the charter-only ships of L. 172/2003 art. 3 in the Registro Internazionale (Lesson 1.2).
Art. 2(1) lists the commercial uses:
- (a) locazione (bareboat hire) and noleggio (crewed charter);
- (b) professional teaching of pleasure navigation;
- (c) support boat for diving centres;
- (c-bis) mooring assistance in marinas;
- (c-ter) assistance and towing of pleasure craft;
- (c-quater) mobile food, drink and retail.
For superyacht crew only (a) matters in practice. The others explain why a marina RIB or a floating bar can also be a "commercial yacht".
What follows from the label
- Crew. On navi da diporto, services on board are performed by seafarers enrolled in the matricole della gente di mare (art. 36(2)). Guests aged 16 or over may help only with complementary cabin and galley work (art. 36(3)). On imbarcazioni the master may let guests help (from 16 on deck, cabin and galley; from 18 in the engine room) (art. 36(1)).
- Command. Units over 24 m in private use need the patente per nave da diporto. In commercial use the professional titles of D.M. 121/2005 apply (Module 3).
- Certificates. Charter units carry the charter fitness certificate or, in the Registro Internazionale, the D.M. 95/2005 safety certificate (Module 2).
TIP — Ask for two numbers Before you accept a job on an Italian-flag yacht, ask for the length (ISO 8666) and the GT from the tonnage certificate. With those two numbers you can place the yacht on the ladder and predict most of the rules that follow.
