Two ladders, not one
Most people arriving in Italy from the Red Ensign world assume there is one ladder, from dayskipper to master, with the leisure tickets on the lower rungs. Italy runs two separate systems. The patente nautica (boating licence) is issued under the Codice della nautica da diporto for people driving pleasure craft. The titoli professionali del diporto (professional yacht titles) and the merchant certificates of competency are for people who work on boats. They are examined differently, issued by different offices and do different jobs. This lesson covers the first; the next covers the second.
When a patente is compulsory
For units up to 24 m, art. 39(1) makes a licence compulsory in three situations:
| Situation | Licence? |
|---|---|
| Beyond 6 nm from the coast, motor or sail | Yes |
| Any moto d'acqua (jet ski) | Yes |
| Inside 6 nm with an engine over 30 kW / 40.8 CV or over the cc limits (e.g. 750 cc two-stroke carburettor, 1,000 cc four-stroke outboard) | Yes |
| Inside 6 nm below those thresholds | No (age limits apply) |
Command of a unit over 24 m needs the patente per nave da diporto, category B (art. 39(2)). Categories A (entro 12 miglia or senza limiti) and the newer D1 cover the smaller boats. A licence lasts 10 years, or 5 years from age 60 (D.M. 146 art. 38).
What it is not
- It is not STCW. D.Lgs. 71/2015, the Italian STCW decree, expressly does not apply to pleasure units that do no commercial traffic (art. 1(1)(c)). Equally, a patente gives you nothing under STCW.
- Sea time on a patente does not count. Codice art. 36(4): a seafarer who serves on a yacht using his patente does not get that navigation recognised for professional purposes. If you are building sea time for a title, sign on under your professional qualification.
- A foreign licence is for unpaid use. D.M. 146 art. 34(1) lets foreign nationals command Italian-flag imbarcazioni, navi, natanti and jet skis on their home licence "purché a titolo gratuito" (provided it is unpaid) and within its limits. On a foreign-flag yacht the flag State decides what licence you need (art. 34(2)).
Where a patente does carry paid work
The law makes a few narrow exceptions, all covered later in the course:
- a crewed hire (noleggio) of a natante (up to 10 m) needs a driver with at least a category A licence;
- the noleggio occasionale of a private imbarcazione may be skippered by anyone who has held a patente for at least 3 years (Codice art. 49-bis(2));
- the patente B holder may command a private nave da diporto over 24 m, and can obtain the UND 2ª classe title without exam (D.D. 40/2025 art. 6).
CAUTION — Do not stretch the exceptions None of these turns a leisure licence into a professional title. A paid skipper on an Italian-flag charter imbarcazione needs a diporto title or must fall inside one of the exceptions above.
Where to go from here
If you want the licence itself, see Patente Cat. A 12 miglia prep or Patente D1 prep. If you are a visitor renting a boat, Renting a Boat or Jet Ski in Italy covers art. 34 in more detail. The rest of this course is about working on yachts.
